“Guns have become wicked” (Readers’ Forum, July 23), I had to hope he was writing tongue-in- cheek and not trying for serious journalism. I was given my first firearm in 1946, and over the years have used firearms for feeding my family, home protection and in recent years target shooting on a weekly basis for pleasure. If what he says is true, I do not dare go to my storage area for fear that the wicked steel now used in guns is just waiting for me to appear so that, all by itself, it can raise up and attack me.  the stupidity of some that use firearms inappropriately. They are the problem and the issue. Not the firearm.

The production of firearms continued to drop in 1997. However, the severe losses following the crash of 1995 slowed, allowing the industry to close 1997 at just above 1992 levels. While a far cry from a complete recovery, it was a welcome shift for the industry.

The forecast, however, isn’t inspiring. With renewed attacks from many foes following recent school shootings, the industry is again fighting for survival. Despite hard-fought opposition, there will be new restrictions on gun production. This will drive some businesses to close their doors, others will consolidate, several will change ownership.

However, those willing to stay the course will prosper in what will be a leaner, more streamlined industry.

Total Production

Total firearms production in 1997 dropped 6 percent from 1996 and 17 percent from 1995. In 1997, manufacturers made 3,606,426 guns, down 229,102 from 1996, and 744,161 fewer than 1995. Most dramatic was the drop of 30 percent from 1994 when production hit 5,161,127. Overall, production fell in all firearm categories.

Remington produced 268,250 rifles (-16%) and 184,294 shotguns (-8%) in 1997, an overall decrease of 12 percent from 1996.

Smith & Wesson’s 380,213 handguns in 1997 were a decrease of 6 percent over 1996.

The top three handgun manufacturers for 1997 were:

* Ruger: 293,363 (-3%) and

* Lorcin: 92,033 (+5%).

The top three rifle producers in 1997 were:

* Ruger: 329,583 (-21%),

* Marlin: 302,545 (-14%) and

* Remington: 268,250 (-16%).

The top three shotgun companies in 1997 were:

* Remington: 284,294 (-8%),

* Mossberg: 262,991 (-8%) and

* H&R 1871:183,884 (+9%).

Handguns

In 1997, handgun production dropped to 1,406,505, compared to 1,484,477 in 1996, a loss of 5 percent. The drop from 1994, when 2,581,961 handguns were made, was a dramatic 46 percent.

Pistol Production

Pistols made a light recovery in 1997 with 1,036,077 pistols produced, an increase of 5 percent from the 985,533 manufactured in 1996.

Increases were posted in .22s (+19%), .25s (+5%) .32s (+53%) and .40/.45/.50s (+3%). Decreases occurred in .380s (-7%) and 9mms (-5%).

Smith & Wesson’s 1997 pistol production was up 19 percent compared to 1996, a welcome change from the 33 percent drop from 1994. S&W posted increases in 1997, compared to 1996, in .22s (+17%) and .40/.45/.50s (+45%).

Sturm, Ruger also advanced its pistol production in 1997, posting a 23 percent increase over 1996. Ruger increased production in all its pistol calibers: .22s (+35%), 9mm (+14%) and .40/.45/.50s (+32%).

Lorcin had a 5 percent increase in pistol production in 1997, with its most significant increase in 9mms (+32%).

Beretta’s production dropped 16 percent in 1997, with its greatest loss in .22s (-58%) and its largest increase in .32s (+77%).

Colt posted a 3 percent increase in 1997, with increases in .380s (+49%) and 9mms (+90%).

The shooting industry is experiencing one of its toughest years. Overall, firearms sales continue to be sluggish, despite price slashing, vigorous marketing campaigns and continued product innovation. While 1995 was a business year that staggered many in the industry, 1996 could carry the knockout blow.

The state of the industry today makes it painful to review the production statistics of 1994. It’s a lot like a last place NFL team looking back at the Super Bowl game they won two years earlier. But, just like rebuilding an NFL team, there are lessons to be learned from past successes.

Shooting Industry magazine normally would have published the 1994 production figures in the Dec. 1995 issue. However, the ATF delayed the release of the information while they refined what was a less-than-accurate reporting system. With improvements in place, the ATF information is more thorough and accurate than it has been since they began keeping records.

Total firearms production in 1994 exceeded 5 million guns, the first time the industry pushed to that level since 1982. Interestingly, handgun production actually dropped in 1994 from the 1993 level, while rifles and shotguns posted respectable increases. Shotgun production had the most impressive increase with 1,254,926 guns made in 1994, the most since 1980.

The 1994 handgun production figure of 2,581,961, compared to 1993’s 2,655,478, was lower because fewer pistols were made. There were 1,995,511 pistols manufactured in 1994, compared to 2,093,186 in 1993. While the 1994 pistol figure was down, it still bested (except for ‘93) any previous year.

Revolvers increased moderately in 1994 with 586,450 guns compared to 562,292 for 1993.

Rifle production was up in 1994 with 1,324,240 guns, an increase of 152,368 over the 1993 level of 1,171,872. This was the best posting for rifles since 1982, except for 1989 when 1,407,317 rifles were built.

The top three firearms manufacturers for 1994, and the number of guns they produced, were Sturm, Ruger: 797,865; Remington Arms 607,508; and Smith & Wesson: 524,765.

In 1994, Sturm, Ruger made 436,041 handguns, 354,355 rifles and 7,469 shotguns. Ruger’s total ‘94 production out-distanced their 1993 figure of 627,744 by 170,121 guns.

Remington Arms, in 1994, produced 204,496 rifles and 403,012 shotguns. This also was an increase over the 1993 figure of 567,773 by 39,735 guns.

Smith & Wesson’s 524,765 handguns during 1994 was an increase of 111,326 over their 1993 production of 413,439.

The top three handgun manufacturers for 1994 were Smith & Wesson: 524,765; Sturm, Ruger: 436,041 and Colt’s Manufacturing: 192,750.

Top rifle producers during 1994 were Marlin Firearms: 358,372; Sturm Ruger: 354,355; and Remington Arms: 204,496.

The top shotgun companies in ‘94 were Mossberg/Maverick Arms: 373,512; Remington: 403,012; and H&R 1871: 216,360.

The top U.S. exporters for 1994 were Smith & Wesson: 114,422 handguns; Remington Arms: 36,973 rifles, 27,835 shotguns; and O.F. Mossberg & Sons: 46,459 shotguns. Smith & Wesson and Remington had fewer exports in 1994 compared to 1993, while Mossberg increased its exports from 1993’s total of 32,472.

The top importers into the U.S. during 1994 were Brazil: 425,452; China: 356,158; and Russia: 282,195. The import business has changed significantly since 1994 because of additional government restrictions. As an example, in the first six months of 1994, China exported 42,600 handguns to the U.S. For the same period in 1995, the number had dropped to 5,900. During the first six months of 1994, Russia imported 105,484 handguns to the U.S. That dropped to 4,171 during the first half of 1995.

Exporting assorted weaponry is big business. It’s been recently reported heavy armament exports alone to the Mideast from the U.S. has reached $50 billion since the Gulf War.

Export of small arms is also flourishing, but smaller players particularly can get into trouble by their ignorance of certain provisions of the federal Arms Export Control Act.

Fortunately for some hit with violations, a number of recent court cases have held that a specific intent to break the law must be shown by the government when an exporter is charged with willfully exporting or attempting to export firearms on the government’s munitions list without proper license. Mere inexperience or negligence may not be enough.

Take one recent case where the government’s evidence was found to demonstrate that a Florida weapons exporter was negligent in not investigating the legal prerequisites to exportation. The government could not prove an intentional, knowing violation of his legal duties, nor was he “purposely perpetuation ignorance to avoid criminal liability.”

The facts in this case involved a failure to sign certain sales invoices for shipment of handguns to Panama and subsequent invoices acknowledging receipt of other shipments, and the refusal to sign as required being based on fear of becoming embroiled in the sensitive conflict between the U.S. and Panama.

The exporter had, however, freely and voluntarily met with customs officers concerning shipments and expressed his belief that he thought it was the seller’s responsibility to obtain the proper licensing.

The basic issue was that the export notices printed on handgun receipts — which generally notified purchasers that “certain products” could not be exported without specific approval of either of two federal agencies — were claimed not to have given the exporter, who was unsophisticated about licensing and arms shipping requirements, adequate notice by their wording that it was unlawful to export the purchased handguns without necessary approval.

The court said Congress did not intend to impose criminal penalties on innocent or negligent errors. Further, the notice didn’t convey sufficient knowledge of exactly what was required under the Act to this defendant, and there was not specific intent to export without a license particular property designated as “defense articles” that were restricted. Plus, no sinister inferences were established by any evidence, such as a plan the firearms were in fact meant to ultimately reach Cuba, or any other destination prohibited under the Trading with the Enemy Act.

The moral of the story is exporters must be acutely aware of all statues and regulations and act accordingly. The exporter in this case was fortunate as it can often be a close call on what conduct is actually negligence and what is not. When in doubt, check with authorities before a transaction is executed. It can prevent substantial and potentially costly legal hassles later.

A proposal to allow openly carried firearms in El Paso County buildings might frighten citizens and government employees and foment violence, elected officials and county employees said Tuesday.

The officials said they support the Second Amendment to the Constitution, which guarantees the right to keep and bear arms. But they said that right must be balanced with the need for safety and open government.

“I have been threatened, and so have members of my staff,” Assessor John Bass wrote Tuesday in an e-mail to county employees. “I’ve been asked if I know ‘what the business end of an AK-47 looks like’ and so forth…. Certain environments and atmospheres encourage a fear factor, and I believe this proposal is one of them.”

The county commissioners are looking into scrapping a 1996 policy banning the open display of firearms in government buildings. The possible change is being championed by the Pikes Peak Firearms Coalition, an influential gunrights group.

The commissioners said they will consult with other elected officials and county managers before voting to eliminate the policy.

Some change seems assured — three members of the five-person panel, Douglas Bruce, Sallie Clark and Dennis Hisey, told the coalition before they were elected Nov. 2 that they would vote to repeal the ban.

State law says anyone with a permit may carry a concealed weapon except in certain places, such as a courthouse. It leaves laws on openly carrying weapons in government buildings up to local governments.

An appraiser on the Assessor’s Office staff, Steve Schleiker Jr., said that allowing guns in his office could invite violence. A gun owner and former Marine for 11 years, Schleiker said he would not carry a gun in public.

“When it comes to public safety, especially when you come into an establishment like this, tempers can flare,” he said. “If an individual comes in here with a weapon, that’s just going to disrupt the whole situation.”

Another employee, Clarence “Skip” Jenkins, had a different view.

“If they walk in with a .45, a .38, it wouldn’t bother me at all,” he said. “But if they started getting erratic, that would be a problem.”

The county has seven elected officials besides the commissioners, and six of them maintain offices where the public can walk in. Some officials were less strident than Bass in assessing the policy change, but all said it could raise security problems.

Treasurer Sandra Damron said she’s concerned about her employees and the cash they handle from tax payments. Public attitudes toward guns are another issue, she said.

“The point is not ‘Do you have to fear people who are openly carrying a firearm?’ because I don’t think you do,” she said. “The question is perceptions on the part of people who may not be as comfortable with firearms as others. And you want county government to be open and accessible to everyone without fear of intimidation.”

Coroner David Bowerman said guns in his office are no problem, as long as he can see them.

District Attorney John Newsome supports the idea, but he wants to hear details on how it would be applied to his offices. Newsome oversees investigations and prosecutions, often dealing with people irked about the outcome of a trial.

Clerk and Recorder Bob Balink has asked the commissioners for additional security at his offices several times in the past two years, and the requests were denied. Balink said he’s optimistic a security guard will be assigned to his downtown office by the end of March.

Are there sexual predators working at equestrian events? Parents and vulnerable children may never know until it’s too late. Why? Because the multi-billion dollar horse industry currently is not required to conduct criminal background checks or licensing for its youth coaches, professionals or workforce. To address this growing national concern for child safety and crime prevention, a new organization, PACES, Professional Accreditation Council of Equine Specialists, has been formed. PACES will require mandatory criminal background screenings, as well as CPR and First-aid training, for all equine certification candidates.

PACES has teamed with a premier nationwide provider of pre-employment screening services to provide background checks to PACES members and their candidates for certification. PACES background screenings will utilize a searchable database of over 230 million records from federal, state, local, and private sources and over 300 million arrest, conviction and disposition records plus 6 billion records from other sources providing the most extensive nationwide sexual offender and criminal database search currently available.

According to PACES executive director, Claudia Starr, “Sexual predators are everywhere. Something must be done about the dangers they present. We want our children protected. PACES believes in the strength of the horse industry to be self-regulating. Applying more stringent standards in our workforce is a positive step for our industry.”

“You wouldn’t buy a horse without a vet check, why would you hire an employee without a background check? PACES is taking a proactive role in risk management and making professional development a priority. Entry level equestrians, skilled professionals, horse-related businesses, and consumers will all benefit from PACES bold new direction,” said Starr.

Sir: I wonder why the Home Office wants to “look at what other firearms controls are needed to safeguard the public”. The Home Office minister Alun Michael gives no indication that the current legislation and administrative practice is in any way deficient. In the absence of any evidence to indicate there is a problem, the setting up of a review will look less like a concern for public safety and more like an attack on legal gun ownership for ideological reasons.

The great raft of firearms law that is already on the statute books provides effective remedies against those who misuse any firearms, including air weapons. Rather than imposing further restrictions, the police and the courts must operate the criminal justice system in an efficient manner. Young people are already heavily controlled when it comes to the possession of firearms. No evidence has been advanced to suggest that these restrictions are in any way inadequate.

Whilst the number of shotgun certificates has fallen by over 25 per cent since 1989, armed crime has risen dramatically during the same period.

ATF Allows Redesigned Firearms

Guess who’s mad at the Bureau of Alcohol, Tobacco and Firearms (ATF). No, not the National Rifle Association. This time it’s the anti-gunners who are upset with the Bureau.

In fact, the anti’s and much of the media became nearly hysterical in late July when they discovered that several companies reportedly had received permission from ATF to import some altered versions of the firearms that were banned from import last year.

To hear much of the media tell it, you can now order air-to-air missiles and M1A1 Abrams tanks (or Leopard II’s for those of you who like imports) through the mail. Every newspaper and network seemed to carry a different version of what ATF’s position is on imports.

We finally asked ATF to clarify this matter and received a detailed reply from a fellow who should know: Stephen E. Higgins, director of ATF.

Higgins began by tracing the events of last year, as he informed SI that, “On March 14, 1989, ATF announced a suspension on the import of certain semiautomatic assault-type rifles, pending a review of whether these rifles met the sporting purposes test under the law. The temporary ban affected over 700,000 rifles covered by import permits already issued or pending approval.

“The ban was made permanent in July of 1989. It was not directed at all semiautomatic rifles. The ban was based on the fact that these weapons all possessed a number of military assault-type characteristics.

“Based on ATF’s firearms expertise, a survey of available literature and responses to questionnaires sent to many outside sources — including hunting and shooting clubs and state hunting officials — ATF determined there was no general recognition that these rifles were suitable for sporting purposes.

“Subsequently, several importers approached ATF to find out what modifications could be made to render their rifles importable. ATF required that all military features be eliminated. Over the past year, ATF has approved seven specific prototypes submitted of the redesigned firearms.

“The weapons approved for importation are in the configuration of traditional sporting rifles. This problem was initially faced when ATF found that one of the rifles on the suspension list, the Valmet Hunter (an AK-47 type), had been substantially altered in appearance and was clearly intended as a hunting rifle.

“ATF determined then that the alteration to the weapon and the fact that it employed a more traditional hunting configuration operated to remove it from the assault rifle category. Consequently, the Valmet Hunter was approved for import at the same time that the permanent ban was imposed on imported assault-type rifles.”

Higgins concluded, “ATF has repeatedly stated that the ban was not intended to interfere with the import of legitimate sporting rifles. As long as the rifles have been modified into a sporting configuration, there are no legal, policy or public safety considerations which would justify the disapproval of their import.”

The imports are considered so different from the originals that they are, in effect, entirely new models that qualify for importation as sporting firearms.

The importers have removed the firearms’ bayonet fittings, night sights, flash suppressors, grenade launchers and pistol grips — the very features that the government claimed made them unsuitable for “sporting purposes.”

However, the anti-gunners immediately screamed “foul” and claimed that the Bush Administration simply was trying to gain favor with pro-gun groups like the NRA, which strongly criticized the administration for banning imports in the first place.

White House spokesman Marlin Fitzwater further angered the anti’s when he told the media that, “Apparently the way the existing rules are written, ATF is not authorized to prevent these weapons from coming in.”

To make matters worse, Fitzwater said that the modified firearms would be allowed in the country under the provisions of the Omnibus Crime Bill that passed the Senate.

The anti-gun Firearms Policy Project (FPP) claims that the firearms that have been redesigned and approved for importation include the Uzi carbine, Galil, K-91, SAR-8 and SAR-4800. It says its assertions are based on documents obtained from ATF under the Freedom of Information Act.

“It’s more than a weakening,” FPP Director Josh Sugarmann told The New York Times. “It essentially renders the July (1989) ban null and void. These guns look less threatening, but they are not less deadly.”

Sen. Howard Metzenbaum (D-OH) — never one to miss an anti-gun cause — proclaimed, “We are either going to keep these weapons off our streets or we are not. The Bush Administration would do well to rethink its policy altogether and ban all assault weapons, foreign or domestic.”

The 4,000-square-foot showroom at Jaqua’s Fine Guns is impressive. All firearms are on display and customers can handle any gun they’re interested in. The sales staff at Jaqua’s is not on commission and each salesman is encouraged to refer customers to a staff expert.

“Everyone has their own area of expertise–handguns, shotguns, rifles or antiques,” Camille said. “We have six full-time sales people and most of them have been with us for over 20 years.”

The atmosphere in the store is very casual and people-friendly. “We have people come in daily just to look,” Camille said.

Jaqua’s also does a very active Internet business. “Our Web site lists our entire inventory and it is updated two to six times a day,” Camille said. “We have customers from all over the world who use our Web site. It’s a tremendous selling tool.”

Recently, Jaqua’s has increased its accessory line, focusing on gun cases, shooting jackets, shirts, cleaning kits and reference books.

“Ladies’ clothing is very difficult to find,” admitted Camille. “Beretta makes terrific ladies’ clothing and Browning is making some.” Jaqua’s also stocks MizMac Designs products.

Camille summed up the key to Jaqua’s Fine Guns longevity and success with, “We buy nothing but quality guns and merchandise that we believe in.”

It’s a simple recipe for success, but one all storeowners should follow. If you believe in a product, it will sell itself and earn you a loyal customer base.
